I am here illegally. Will I be reported if I hire an attorney for representation?
No, your attorney will not report you. Your immigration status is attorney-client privilege. It’s recommended you discuss your immigration status with your attorney so you can properly be advised on the repercussions of being charged and/or convicted of a crime.
I was just arrested and charged, now what?
Shut up. Don’t say anything to anyone. You don’t need to explain yourself to the police. You are under no obligation to speak a word to anyone. Contact an attorney and discuss the situation with them before you say something you may not have meant.
Does it matter if I have a privately paid attorney versus a public defender or court appointed attorney?
No. In all honesty, it depends on the attorney. There are good and bad lawyers working both publicly and privately. Luckily, Gaston County has excellent public defenders and attorneys that accept court appointed cases. However, the attorney, whether paid for you or by the state, work just as hard on your case. Money isn’t a factor because the attorney is getting paid by either you or the state if you cannot afford an attorney.

I got a speeding ticket. Should I just go ahead and pay it?
Probably not. Hiring an attorney for a speeding ticket is not as much as the extra premiums you will pay. On average a speeding ticket without any other points on your license will increase your monthly premiums by around $30 for 3 years which come out to a little over $1,000 total. So really, a couple hundred now will save you hundreds later, not to mention will likely keep extra points off your license in the event you get another ticket.

After an expungement, will employers be able to see I had an expungement.
No. An expungement means it is erased as if it never happened and will not show up on background checks, which is why it is advised to get an expungement if you’re eligible to have one.
